Sales Terms & Conditions
All descriptions & conditions are given in good faith, however no warranty is expressed or implied. All descriptions & conditions are the seller's studied opinion and is a subjective art, so opinions can and do vary between sellers, buyers & experts. All sale items are offered/sold 'as is' and may not be returned for any reason without SMP approval. If there is any uncertainty please contact us before placing your order.
All prices are in US dollars.
Every person ordering (i.e., Buyer) is personally liable for their purchases and may not claim to act for the account of a third person.
By placing an order/reservation, you are in effect "signing" a legal and binding contract to buy the item(s) ordered. Orders of a fraudulent/criminal nature are not permitted, and may result in legal action. Once you place an order, you cannot retract it except in exceptional circumstances and at the sole discretion of SMP. Please order carefully!
SMP is not responsible for any E-mail, USPO Mail orders NOT received by SMP and/or if mis-delivered.
PAYMENT
At this time, SMP accepts only Money Orders or Checks. Money Orders or Checks must be in US dollars and redeemable in New York City at J. P. Morgan Chase Bank without additional special handling or bank fees.
Buyer payment (including shipping/handling, insurance, taxes) must be made in full, in US dollars and be received by SMP no later than 1 week (7 days) after any email reservation. Please allow 10 business days for payment to clear. After payment clears, shipment will be made. Sending less than the total amount (including shipping, insurance tax) is not accepted and may void the order/reservation.
Buyers must pay all postage, insurance, and custom charges associated with delivery of ordered item(s). It is the responsibility of the Buyer to comply with foreign customs and other regulations. Any applicable tax or duty not collected by SMP at the time of sale remains the responsibility of the Buyer and the Buyer agrees to pay the same on demand together with any interest or penalty that may be assessed.
Sales delivered in New York State shall be subject to New York State and local sales tax which will be collected by SMP before shipment. New York State tax exempt Buyers must have a current signed (wet signature) exemption/resale certificate on file at SMP. Buyers receiving delivery outside of New York State agree to be responsible to pay any required destination (city/state/county/country etc.) taxes and or associated fees directly to the appropriate destination (city/state/county/country etc.) taxing authority.
In the event a Buyer fails to make full payment, SMP reserves the right to resell the item(s). Buyer grants SMP or its assigns the right to offset any sums due, or found to be due to SMP by any Buyer's funds held by SMP.
SHIPPING & INSURANCE
SMP uses USPS Parcel Post for shipping in the USA. International delivery is available for an additional fee. Lots sent to foreign addresses are sent Registered mail and at the Buyer's risk.
Buyers can combine items for one shipping charge. U.S. Postal Regulations allow for up to six weeks for delivery, but Buyers often get shipments in about half that time or less. We have customers in all fifty states and dozens of countries worldwide.
Please refer to the chart below for shipments within the continental United States. Some shipments to Alaska, Hawaii, Canada, APO, FPO and overseas locations will be charged according to actual cost. All shipments are professionally packaged and shipped fully insured via USPS.
Shipping Cost (Insurance included) is based on Merchandise Purchase Value for packages no larger than 130 inches in combined length and distance around the thickest part; weight not over 70 lbs.

The above rates are subject to change. Shipping cost for packages outside the criteria above will be quoted separately.
AMENDMENTS
SMP may amend the Terms & Conditions at any time and will post the amended Terms & Conditions online. Acceptance of the SMP Terms & Conditions also includes any future changes to the Terms & Conditions.
This Agreement (aka: Sales Terms & Conditions) shall be governed by and is to be interpreted, construed and enforced in accordance with the laws of New York.
