I just came across a website that sells reproductions of salt spoons in an amazing array of styles. My question is how do they do this without infringing on Copywrite Laws? They are marked "Sterling" and are not marked by the manufacturer's mark. My recollection is that this may be unlawful. Any input? IP: Logged |

Can you tell if they are actual duplicates of the originals or are they just real close? Even a very small variation is enough to invalidate claims of design infringement. This presumes they are not offered as the original, of course. IP: Logged |

These reproductions appear to be castings from moldings of the original spoons. I have seen repros offered in several of the shops here in town. The ones I have seen here are recognizable as reproductions. The craftsmanship is not there... I have not taken the time to compare the designs to see if they are itentical in style and design. Fred, I have seen such spoons. Yes, they are often exact copies (well, as you said, minus a lot of the detail and hand-finishing) of popular patterns, including Love Disarmed, Chantilly, Old Orange Blossom, etc. My guess is that the manufacturers aren't losing a whole lot of money to people selling reproduction salt spoons. Somebody who wants a Chantilly salt spoon for their service probably wouldn't purchase a recast, since recasts are far inferior (I see them in shops from time to time). And somebody willing to purchase the lesser quality recasts probably wouldn't want to pay extra for a real salt spoon. So, it probably does infringe on copyright laws (unless the design patents expired & weren't renewed), but it's probably not worth the original manufacturer's time and $$ to take action. Incidentally, the recast industry doesn't limit itself to salt spoons. I recently saw a fake Old Orange Blossom food pusher in a shop. With the lack of fine detail or hand finishing, it was quite a hideous specimen. Have also seen several knock offs of Gorham's 1880s fish/crab motif coffee spoons & related shell dishes, as well as of Tiffany's Strawberry pattern. Usually I don't see these recasts, at least salt spoons, offered as originals. Sometimes an eBay listing will be deceptively worded though. The number of Salt spoons are getting a bit ridicules as they are very small and can be purchased in the hundreds from over seas through a number of dealers… They are only marked sterling which means they meet the import laws (in their most minimal terms), but there is no way anyone would purchase these without knowing they were not real… at least I would hope not. I agree, I have seen a number of the higher priced pieces being recast and some being sold by a number of people I would not have suspected. One Dealer had a set of Bridal Rose Salad pieces with a starting bid of $100.00 on a premier auction on EBAY. When I sent them a email on the authenticity (Heavy sand cast marks) they stated that they were not selling these as originals. Recasts are not the only ones… What about the basic teaspoon that becomes the baby food pusher, or the Pierced table spoons, hollowware with new findings… they are designed to deceive and make the collectors I know a bit upset… I really hate going to a location on the web and finding what I thought might be a real piece only to learn that the thing started life as something else… IP: Logged |
